US Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to face human smuggling allegations, he was held in immigration custody.
In her order, the court noted that the government lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Background of the Legal Challenge
The legal proceedings involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.
Conditions of Release
The judge, who was hearing his petition to removal in a federal court, determined that he must now comply with the conditions of his release from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
This ruling marks a significant development in a complex legal case featuring claims of mistaken imprisonment and contested gang affiliations.
